Ha!
I've been looking at it obsessively for two days now. It's clear that the left hand is really gripping the right hand in some way and probably not touching the pistol itself. You couldn't extend the arms at all to get him to look like he's shooting, even if you can get the exact pose to stay stuck together like that (I couldn't get a Cobra Trooper to look anything like this -- I think it would have required blue tac or something to stick the hands together and then a clever camera angle).
Figures being able to hold their guns and look like they could use them is a pet peeve of mine. Double jointed elbows finally allowed for rifle shooting poses, but pistols remain purely decorative (unless you like dual wielding or 18th century dueling poses).

I know it's not fault of the figure but I wish Jon had his Wolf of the Wallstreet haircut which is much closer to comics Punisher haircut.
As for the figure it is mostly good but these elbow joints are getting out of hand, almost reminds me BND Hulk knees, Hasbro knows how to sculpt both of them in a seamless way, for example Spider-Man 2099 had brand new arms and they are pretty much sculpted well, why do they have such weird design decisions is beyond me.
